Abstract

The essence of the ding rights is indicated in the land development right. It causes conflicts between traditional interests and quite a number of factors promoting the advancement of modern society. The government should issue ding rights certificates to all eligible indigenous inhabitants, and meanwhile establish an open and transparent transaction platform to allow free transaction of certificates. This plan may present inspiration and enlightenment for other areas in the world to handle the issues concerning traditional rights in the future.

[18] Tso/Tong lands, commonly known as ancestral land, refer to the village lands in the New Territories that is collectively owned by a clan, family or the traditional organization such as “t’ong” rather than by an individual. The lands for ancestral shrines, temples and tombs in villages of NTIIs (who settled in Hong Kong before 1898) are mostly Tso/Tong lands. However, substantial Tso/Tong lands are agricultural lands, with the rental income used for the operation of Tso/Tong and the welfare of the clan.
