Abstract

General Secretary Xi Jinping has repeatedly put forward the holistic view of national security and the construction of a Cyber power on multiple important occasions such as the 20th National Congress of the Communist Party of China. Improving the supervision of cross-border data flow is an inevitable measure to ensure national security and is also the inherent meaning of building a Cyber power. Under the strategic guidance of the overall national security concept, by reviewing the current practice of cross-border data flow in China and combining with foreign legislative experience, we can find that there are many difficulties in the supervision of cross-border data flow in China. The basis for regulating cross-border data flow needs to be coordinated, the review and evaluation standards for cross-border data flow are not clear, the regulatory entities for cross-border data flow are relatively dispersed, the boundaries of responsibility are not yet clear, and the whole chain supervision of cross-border data flow needs to be improved. Therefore, how to overcome these difficulties and build a scientific data cross-border flow regulatory system while taking into account external and internal security has become the focus of our research.
